CONDITIONS FOR GRANT OF CERTIFICATES OF ELIGIBILITY FOR BUSINESS OF PRIZE-WINNING ELECTRONIC GAMES
1. General Conditions
- A company shall only qualify for the certification of eligibility for prize-rewarding electronic gaming business after being licensed by competent authorities to establish and operate a tourist accommodation establishment and registering for conducting the prize-rewarding electronic gaming business pursuant to the Law of Investment and the Enterprise Law.
- Having a tourist accommodation establishment of five-star class or high or superior class as ranked by a competent state management agency in accordance with the Law on Tourism and guiding documents.
- Possession of the charter capital of no less than VND 200 billion.
- Having an effective plan on business of prize-winning electronic games and ensuring security, social order and safety in accordance with law.
- A tourist accommodation establishment may be considered for grant of only one (1) business eligibility certificate and such business eligibility certificate may only be granted to the enterprise owning such establishment.
2. Business facilities conditions: must be located separately from other business areas of the enterprise and fully satisfy the following conditions
- Having separate entrance and exit doors.
- Having electronic equipment and cameras for constant monitoring and surveillance of all activities in the facility (24/24h). All footages must be fully preserved for at least between 15 and 30 days from the date of recording depending on each position in the facility. In case of necessity, the preservation duration may be longer at the request of competent state management agencies.
- Having security guards fully equipped for protection, fire and explosion prevention and fighting and emergency exits to assure security and safety in accordance with relevant laws.

3. Manager Conditions: who have good ethical quality and professional qualifications of university or higher level; have worked for at least 3 years in the management of prize-winning electronic games; and are not banned from establishing and managing enterprises
- Who are banned from establishing and managing enterprises as prescribed in the Enterprise Law and another provisions.
- Minors; people that are legally incompetent; organizations without legal status.
- Has been criminally prosecuted and being under the investigation, prosecution or adjudication by a Vietnamese or foreign procedural body.
- A person is liable to the compulsory educational measures at the community; is waiting for a decision on imposition of an administrative penalty granted; is addicted to drug; is suspended from the compliance with a decision on serving a sentence in correctional institution or rehabilitation center; or has faced an administrative penalty but the period for being considered as not yet facing an administrative penalty is not satisfactory as regulated.
- A person has a criminal record on infringing upon the national security or deliberate commission of a crime liable to a prison term of 03 years or more which has not yet been expunged; or is suspended from serving a prison sentence; or is serving a non-custodial rehabilitation; or is under the mandatory supervision, or the prohibition from residence or holding certain position or running a business sector subject to security and order conditions upon the court’s decision.
- Vietnamese people who hold foreign passport and reside abroad, and foreigners who are not permitted by a competent authority of Vietnam to stay in Vietnam.
