Things you should know to place football bets

World Cup football tournament 2018 is coming. Upon receipt of questions from members of Cộng đồng Dân luật regarding football betting, we would like to give you some instructions for regulations on betting activities, betting operators and their tax obligations.

 According to the Decision No.1064/QD-BVHTTDL announcing the list of selected football matches and international football tournaments as the basis for betting business in 2018 (phase 1), all football matches of World Cup 2018 taking place in Russia in June and July of 2018  will be in the list.

 When the Decree No.06/2017/ND-CP came into force from March 31, 2017, it is the first time that the betting on horse racing, greyhound racing and international football games has been legalized. Subject to provisions laid down in this Decree, bettors and betting operators must obey strict requirements.

* Regulations on the bettors:
>>> Bettors must be at least 21 year olds and have fully legal capacity as prescribed by law.
>>> Following persons are not allowed to place bets:

a) Persons not satisfying the requirements specified in Clause 1 of this Article; 
b) Managers, directors and employees of betting operators and their parents, spouses and children must not place bets through the operators they work for; 
c) Members of the Race surveillance councils of horse races or greyhound races and their parents, spouses and children must not place bets on the races which are under their surveillance; 
d) Jockeys, players, referees and their parent, spouse and children must not place bets on races and football matches and tournaments that they participate or control;dd) Persons whose parents, spouses or children who have fully legal capacity or who themselves request the betting operators to prevent them from placing bets; 
e) Persons who are liable to criminal prosecution or have incurred penalties which have not been expunged; persons who are incurring the measure of education at reform schools or rehabilitation centers.

- Limits on the amount of bets:
+ The minimum amount of each bet must not be less than VND 10,000 (ten thousand dong).
+ The maximum amount of bet that each bettor can place on each betting service of a betting operator per day must not be greater than VND 1,000,000 (one million dong).
 Minimum or maximum limits on the amount of bet will be modified over periods


>>> Bettors will have following obligations:
a) Present personal identity papers to prove their eligibility to place bets at the request of competent authorities; 
b) Comply with law on betting business and applicable betting rules;
c) Fulfill tax obligations to the State as per law;
d) Do not commit any fraudulent act when placing bets;
dd) Keep the betting tickets to receive winnings or prizes.

>>> Bettors will be responsible to pay personal income tax on income generated from winnings or prizes
 The formula for calculation of Personal Income Tax payable = Taxable income x 10%

* Betting operators
 Betting business is a conditional business, not encouraged for development and must be subject to strict control of competent regulatory bodies. Thus, only eligible operators are allowed to do the betting business. Operators after completing investment registration procedures must apply for the Certificate of eligibility for betting business.

>>> Betting operators will distribute betting tickets through:
+ Terminal equipment;
+ Phones (landline or hand phones)

>>>   Regions allowed for international football betting business are as follows:
+ Several provinces or central-affiliated cities where betting tickets are distributed via terminal systems.
+ The entire nation where betting tickets are distributed via terminal and phone systems.

The betting operator may directly establish or select a betting ticket agent to establish fixed betting ticket sale booths for distributing betting tickets. The establishment of fixed betting ticket sale booths shall satisfy the following requirements: 
1. Being located in the betting area as per law. 
2. Ensuring that there is no school or public playground for kids within a radius of at least 500 m. 
3. Ensuring the infrastructure’s capacity of transferring sufficiently and promptly the information of betting.

>>> The Government will permit a betting operator to carry out the pilot betting business within a period of 05 years. Betting operators permitted to carry out the pilot international football betting business must have the charter capital of at least VND 1,000 billion and satisfy other regulations on:

+ Plans for investment in the betting technology, technical equipment and software systems which ensure modernity, synchronization, easy access to system upgradation, accurate, safe and stable control;
+ Feasible plans for the betting business on international football games, betting ticket distribution methods and betting ticket publishing locations in compliance with this Decree and other law;
+ Commitment complying with Vietnamese and international laws;
+ Commitment assuring the social security and order and participation in corporate social responsibility events.
Betting operators must hold the Certificate of eligibility for betting business.

>>> At least 05 working days before the day on which the betting business begins, the betting operator will: Send their betting rules to the Ministry of Finance, the Department of Finance and the supervisory tax authority of their registered business locations for supervision and management purposes;

-  Betting operators will fulfill tax obligations and pay contributions to the state budget under applicable laws
 The Circular No.101/2017/TT-BTC guiding the Decree No.06/2017/ND-CP on betting business on horse racing, greyhound racing and international football games prescribes that:
+ Each betting operator must keep separate records of revenues, expenses and profits in relation to sports betting business and must make separate reports on these accounts in the system of accounting records and financial statements.
The betting operators will withhold personal income tax amounts paid by employees of the betting ticket agents before paying commissions to these agents according to tax law.

>>> Notice:
+ Betting on all football matches involving Vietnam's male and female football teams in ASIAD or SEA Games are not legal.  
+ Betting operators are not allowed to offer any promotion to bettors in any form during their betting business.
+ All bets in breach of the Decree No.06/2017/ND-CP will be punished according to law.
