When foreigners are living and working in Vietnam: When you register a marriage, give birth and get divorced

1. When you register a marriage

You need to identify whether the person you are marrying to is a foreigner or a Vietnamese

Case 1: A foreigner marrying a foreigner in Vietnam

Come to your country's consular office in Viet Nam to carry out marriage registration procedures in accordance with regulations of your country.

2. When you give birth

Note on naming your children:

If you claim Vietnamese nationality for your child, then you must pick a Vietnamese name for him/her that does not include any figure or non-alphabetical character.

(According to the Civil Code 2015)

Procedure for birth registration:

Step 1: Prepare the documents below: 

- Birth declaration form given in the. (attached file)

- Birth certificate. In the absence of birth certification paper, a document of a witness certifying the birth shall be submitted; in the absence of the witness, there must be a written pledge of the birth.

- Agreement on child’s nationality.

If you claim a foreign nationality for your child, this agreement must be certified by your state competent authority.

Step 2: submit abovementioned documents to the People’s Committed where you live.

The civil status officer and you both will sign in the civil status book. Then the Justice Division report to the chairperson of the district-level People's Committee to grant your child a birth certificate.

3. When you get divorced

Like marriage, when you divorce, you need to identify whether your spouse is a Vietnamese or foreigner

If your spouse is a foreigner , you are required to contact your home country's consular office in Viet Nam to carry out divorce procedures in accordance with regulations of your home country.

If you spouse is Vietnamese, the procedure shall be implemented as below:

Case 1: Divorce by mutual consent

Prepare the documents below: 

- Petition for divorce by mutual consent. (attached file)

- ID card of the Vietnamese party and passport of the foreign party.

- Marriage certificate.

- Birth certificate of your children (if any)

Submit the abovementioned dossier to provincial-level People’s Court where you live.

Time limit for processing your request: 1 to 4 months

Case 2: Divorce without mutual consent

Prepare the documents below: 

- Petition for divorce at the request of one spouse (attached file)

- ID of the Vietnamese party and passport of the foreign party.

- Marriage certificate.

- Birth certificate of your children

Submit the abovementioned documents to provincial-level People’s Court where you live.

Time limit for settlement of divorce: from 4 to 6 months  if at the first instance court, from 3 to 4 months for appellate court.
