41. Dong Thap

Urban zone:
- House lot: The permissible minimum area for splitting is 40 m2.
- Vacant lot: The permissible minimum area for splitting is 70 m2.
Rural zone:
- House lot: The permissible minimum area for splitting is 60 m2.
- Vacant lot: The permissible minimum area for splitting is 80 m2.
Notwithstanding the aforesaid regulations, the minimum length of each side from the setback line must be 3.0m.
With respect to zones having the approved detailed plan of 1/500 scale, the minimum area of the lot shall be subject to such plan.
Splitting of the non-agricultural lot (not residential land) shall require submission of an investment project appropriate to the development plan approved by a competent authority.    In this case, the permissible minimum area for splitting shall be 200 m2, irrespective of whether the lot is located at rural or urban zones.

42. Soc Trang

* With respect to property used for residential and commercial purposes: Regulations prescribe that the permissible minimum area for splitting shall be 40 m2 (exclusive of areas of public utilities easements), and splitting of the lot for building of a home or development of construction projects in a commercial split lot must accord with National Technical Regulations on the Construction Planning.

44. Son La

* Residential land
- Urban zone (wards or townlets): The permissible minimum area of a split lot is 35 m2.  The minimum length of the side adjacent to a road must be 3.5 m and the minimum depth of a side must be 5 m.
- Rural zone: The minimum area of a split lot recognized as a residential lot shall be regulated as follows: 
+ Market zones, centers of groups of communes, centers of communes, areas bordering on built-up areas (within a distance of 100 m from the boundary line of a ward or townlet), or land lots adjacent to a road of which the width between its boundary lines is at least 13 m: The minimum area of a split lot must be 50 m2 and its side abutting onto a road must be 4 m long and its minimum depth must be 5 m.
+ Other areas: The minimum area of a split lot must be 60 m2 and its side abutting onto a road must be 5 m long and its minimum depth must be 6 m.


45. Ha Giang

- * Residential lots formed by splitting carried out by family households or individual on their own must conform to the following requirements:
The minimum area of a split lot, exclusive of the setback area, must be 36.0 m2; the length of its side abutting onto a main road must be 3.0 m; the minimum depth of the lot must be 5 m.
- If a right-of-way road is created by splitting of a lot located within a residential zone which is carried out in accordance with paragraph 1 of this Article, that road must have a cross section of ≥ 2m.

46. Tay Ninh

* The minimum area permissible for splitting of a residential lot or an agricultural lot located within an existing residential zone, appropriate to the residential land planning or located within the residential zoning approved by a competent authority shall be subject to the following regulations: 
- At wards, townlets:
+ If it is located on a road of which the planned width between its boundary lines is greater than or equal to 20 meters, the permissible minimum area for splitting must be 45 m2.
+ If the road has the planned width between its boundary lines which is less than 20 meters, the permissible minimum area for splitting must be 36 m2.
- At communes:
+ If it is located on a road of which the planned width between its boundary lines is greater than or equal to 20 meters, the permissible minimum area for splitting must be 60 m2.
+ If the road has the planned width between its boundary lines which is less than 20 meters, the permissible minimum area for splitting must be 50 m2.

* In addition to a requirement concerning the permissible minimum area for splitting, the newly-formed lot and the remaining lot after split must satisfy the requirement that an access to a public road between them must be created (its dimensions do not depend on the width and depth of the lot referred to in this Article), and have dimensions prescribed as follows: 
- If a residential lot or an agricultural lot is located within an existing residential zone and corresponds to the residential land planning:
+ At wards or townlets: the minimum length of its side must be 03 meters;
+ At communes: the minimum length of its side must be 04 meters.
- If a residential lot or an agricultural lot is located within the scope of the residential zoning approved by a competent authority:
+ On a road of which the width between its boundary lines is greater than or equal to 20 meters: the minimum length of its side must be 05 meters;
+ On a road of which the width between its boundary lines is less than 20 meters: the minimum length of its side must be 04 meters.


47. Ha Nam

* If a lot of a family household or an individual included in the district-level land use planning is a residential lot, in order to be permitted for splitting (except when it is subject to the detailed zoning approved by a competent authority), the following requirements must be satisfied: 
- At wards or townlets: the permissible minimum area must be ≥ 40m2; the minimum width and depth must be ≥ 3,5m. 
- At communes: the permissible minimum area must be ≥ 60m2; the minimum depth must be ≥ 4m.
* A right-of-way access created after land split
- If a right-of-way access to an existing alley having a cross section of ≤ 3m is formed, the minimum width of a newly-formed access must be equal to the width of the existing alley. 
- If a new right-of-way access or the one to the existing alley having a cross section of > 3m is formed, the minimum width of a newly-formed access must be ≥ 3m. .

* If a lot located within a residential relocation zone or a commercial lot is permitted for splitting, the following requirements must be satisfied: 
- At wards or townlets: the permissible minimum area must be ≥ 40m2; the minimum width and depth must be ≥ 3,5m. 
- At communes: the permissible minimum area must be ≥ 60m2; the minimum depth must be ≥ 4m. 


48. Thai Binh

* The minimum area and dimensions of a split lot shall be subject to the specific regulations below: 
- Urban residential land: The minimum area of a split lot must be 30 m2; its minimum width and depth must be 3m; 
- Rural residential land: The minimum area of a split lot must be 40 m2; its minimum width and depth must be 4m. 

* Lots formed after split must have the area and dimensions which are not less than the minimum area and dimensions provided by paragraph 1 of this Article.  If a lot is split into two or more individual ones, including a lot of which the area and dimensions are less than the aforesaid ones and of which application for combination with another adjacent lot is submitted to create a new lot of which the area and dimensions are equal to or greater than the minimum ones prescribed above, splitting shall be allowed; lot splitting and combination processes may be carried out concurrently.  

* An access to the lot formed after such splitting and combination must be available.
* If a lot is located within areas having the detailed zoning approved by a competent authority or those already having the land acquisition notice, splitting of that lot shall not be allowed.


49. Thai Nguyen

* With respect to land lots for cultivation of annual crops, perennial crops and aquacultural production, the permissible minimum area of a split lot must be equal to or greater than 150 m2; 
* With respect to land for forestry production, the minimum area of a split lot must be equal to or greater than 1,000 m2. 
* If a land parcel is used for both residential and agricultural purpose, the minimum area of individual split lots shall be the same as the aforesaid.    
* If a lot is located within a built-up area or is planned to become a residential lot, the minimum area of the split lot must be 40m2, the minimum length of its side abutting onto a road must be 3m and its minimum depth must be 5m. 

* If a lot is located within a rural zone or is planned to become a residential land, the following specific regulations must be observed:
- If the lot is located at hilly communes, the minimum area of the split lot must be 60m2, the minimum length of its side abutting onto a road must be 4m and its minimum depth must be 5m. 
- If the lot is located at mountainous or highland areas, the minimum area of the split lot must be 70m2, the minimum length of its side abutting onto a road must be 4m and its minimum depth must be 5m. 
* With respect to land lots used for non-agricultural production or planned to become those intended for non-agricultural production purpose, the minimum area of the split lot must be 100 m2, the minimum length of its side abutting onto a road must be 4m and its minimum depth must be 5m. 
* In case of change of purpose of a lot according to the land use planning or plan approved by a competent authority, the area of the residual part of a lot and the area of the lot of which purpose has been changed after split shall be identified based on land type referred to in this regulation.

- The allowed minimum area must be 50 m2; 
- The minimum length of their side must be 4m.   
* If they are located at mountainous communes,
- The allowed minimum area must be 60 m2; 
- The minimum length of their side must be 5m.  

52. Hai Duong

* With regard to a residential lot located within a built-up area, the minimum area of a split lot must be 30 m2 and the minimum length of its side abutting onto a main road must be 03m, and the minimum length of its side perpendicular to a main road must be 05m.   
* With regard to a residential lot located within a rural area, the minimum area of a split lot must be 60 m2 and the minimum length of its side abutting onto a main road must be 04m, and the minimum length of its side perpendicular to a main road must be 05m.

54. Hai Phong

* A lot formed from splitting must fully satisfy two following requirements: 
- If it is located within a built-up area (at wards of districts and townlets of districts), the split lot must have the minimum area from which the prescribed setback space is excluded, the length of its shortest side which is ≥ 3.0m and have total area of ≥ 30.0 m2.     
- If it is located within a built-up area of communes of districts, it must have the permissible minimum area for splitting which is 50% as much as the new minimum limit within which a residential lot is allocated in accordance with Article 4 of this Decision. 
If a right-of-way road is created by splitting or division of a land parcel, that road must have a cross section of ≥ 1.5 m and the area and dimensions of the private lot must ensure conformity with the aforesaid regulation.

* If any tenant applies for the split of the existing land parcel into individual land lots of which the area of each is less than the permissible minimum area and the combination of that lot with other adjacent lot in order to create a new land lot that conforms to the aforesaid requirements, both splitting and combination processes will be allowed, and the certificate of the right to use that new lot will be given.   
* If the part of the lot remaining after split fails to conform to the aforesaid requirements, splitting of that part shall be prohibited.

- The width of the lot must be ≥ 4m.
- The depth of the lot must be ≥ 4m.

58. Hoa Binh

- The minimum area must be ≥ 40 m2; 
- The minimum width must be ≥ 4 m;
- The minimum depth must be ≥ 4 m.

* At urban areas, including wards of cities and townlets of districts, if the split lot conforms to the following area and dimensional limit, it will be permitted for splitting and will be given the relevant certificate: 
- The minimum area must be ≥ 36 m2; 
- The minimum width must be ≥ 3 m;
- The minimum depth must be ≥ 3 m.


59. Tuyen Quang

* In order to be eligible for splitting, the land parcel located at rural areas or built-up areas must cover an amount of area that may be split to form an individual lot which has the minimum area of 36 m2 (exclusive of the area of public utilities easement) and has a side adjacent to a road or right-of-way access as well as satisfy the following requirements:   
- The lot proposed for splitting must be accredited by the certificate of the right to use land or the certificate of the right to use land, own house and other attached property, and conformable to the planning approved by a competent authority and must not be in dispute. 
- The newly-formed lot must have the minimum width of 04 meters, the minimum depth of 09 meters from public utilities easement markers or construction planning boundary lines approved by a competent authority.

* If the newly-formed lot after split covers an area of less than 36 m2 or has the length of its side which is not consistent with aforesaid requirements, but has already had a permanent private house built before January 1, 2009, it shall qualify for the splitting process.  Tenants must comply with laws on construction when carrying out alteration or reconstruction of their homes. 

* If a tenant applies for the split of a land parcel into an individual land lot of which the area is less than 36 m2 and then combination of that lot with another lot to create a new lot of which the area and dimensions conform to the aforesaid requirements, such application for splitting shall be approved.   


 60. Vinh Long

Lots formed from splitting must have the area, width and depth from the setback line (a boundary line that limits a lot of land on which building of a facility is permitted) which are not less than the permissible minimum level as follows:

- With respect to land lots other than the aforesaid, the minimum area of a split lot must be 50 m2; the minimum width of the frontage must be 4m; the minimum depth must be 10.0m.

 The minimum dimensions of a split lot must satisfy the following requirements: the width of its side adjacent to a road (i.e. urban roads, alleys, water supply systems, wastewater drains developed under the approved detailed planning, national highways, provincial roads or district roads) or its depth must be greater than or equal to 4m if it is located at wards or townlets; if the lot located at communes is not adjacent to national highways, provincial roads, district roads or inter-communal roads, its width and depth must be equal to or greater than 5m. On the contrary, if it is adjacent to these roads, its width and depth must be greater than or equal to 4m on condition that its area is not less than the minimum lot area specified in the chart above.

* The minimum area and dimensions of the newly-formed lot and the remaining part of the original lot shall be regulated as follows: 
- If the lot is located at wards and townlets, its area shall not be less than 40 m2, and the length of the side of frontage and its depth shall not be less than 3.5 m; 
- If the lot is located at communes, its area shall not be less than 60 m2, and the length of the side of frontage and its depth shall not be less than 4.0 m; 

* With respect to land used for cultivation of perennial plants, annual crops and aquacultural production, the following regulations must be observed: 
- If it is located at wards or townlets, the minimum area of a split lot must be equal to or greater than 100 m2;
- If it is located at communes, the minimum area of a split lot must be equal to or greater than 200 m2.

* With respect to land used for growing rice:
- If it is located at wards or townlets, the minimum area of a split lot must be equal to or greater than 150 m2;
- If it is located at communes of districts like Tram Tau and Mu Cang Chai, the minimum area of a split lot must be equal to or greater than 100 m2;
- If it is located at other communes, the minimum area of a split lot must be equal to or greater than 200 m2.

* With respect to land used for forestry production:
- If it is located at wards or townlets, the minimum area of a split lot must be equal to or greater than 1,000 m2;
- If it is located at communes, the minimum area of a split lot must be equal to or greater than 2,000 m2.
