Decree No. 31/2021/ND-CP, providing instructions for implementation of
the 2020 Law on Investment in effect as of March 26, 2021, Contains the
Appendix listing several services and activities subject to restrictions on
foreign enterprises’ investment. Below is this list:
1. Trading goods and services on the list of commercial State monopolies.
2. Press and information gathering activities in any form.
3. Fishing or fishery production.
4. Investigation and security services.
5. Judicial administration services, including judicial expertise
service, bailiff service, property auction service, public notary service,
estate guardian service.
6. Sending employees to work abroad under employment contracts.
7. Investment in the construction of cemeteries and graveyards for
transfer of rights to use land associated with their infrastructure
8. Household garbage collection service.
9. Public opinion polling (public survey).
10. Blasting service.
11. Manufacturing and trading weapons, explosives and combat support
equipment.
12. Import and demolition of used marine vessels.
13. Public postal service.
14. Merchanting trade of goods.
15. Temporary import and re-export activities.
16. Exercising the rights to export, import and distribution of goods on
the list of goods subject to prohibition on exercising the rights to export,
import and distribution of goods by foreign investors, foreign-invested
economic organizations.
17. Acquiring, purchasing and disposing of public property at the armed
forces' units.
18. Manufacturing military materials or devices; trading military
equipment and supplies for use by armed forces, military weapons, equipment,
technical devices and means specially used for military and public security
purposes; components, parts, spare parts, supplies, equipment specially
designed for military uses and technologies specially used for manufacture
thereof;
19. Trading intellectual property representation services and
intellectual property valuation services.
20. Establishing, operating, maintaining and servicing aids to
navigation, water zones, water areas, navigational channels for public use and
maritime routes; surveying water zones, water areas, navigational channels for
public use and maritime routes for the purposes of announcement of maritime
notices; surveying, constructing and publishing nautical charts for water
bodies, seaports, navigational channels and maritime routes; designing and
publishing marine safety documents and publications.
21. Regulating and ensuring maritime safety in water zones, water areas
and public navigational channels; marine electronic communication service.
22. Testing, inspecting and granting certificates to means of transport
(including systems, fittings, equipment, components of vehicles); testing,
inspecting and issuing certificates of technical safety and environmental
protection to vehicles, specialized equipment, containers, and dangerous goods
packaging equipment used in transportation; testing, inspecting and issuing
certificates of technical safety and environmental protection for oil and gas
exploration, exploitation and transportation means and equipment at sea; carrying
out technical inspection and testing of occupational safety for machines and
equipment subject to strict occupational safety requirements that are installed
on means of transport and means and equipment used for marine oil and gas
exploration, exploitation and transportation; fishing vessel registry service.
23. Natural forest investigation, assessment and exploitation (including
logging and hunting, trapping rare and precious wildlife; management of plant,
livestock and microorganism genetic resources used in agriculture).
24. Examining or using new livestock genetic resources before appraisal
and inspection by the Ministry of Agriculture and Rural Development.
25. Travel service, except inbound travel service for international
tourists entering into Vietnam.

None of regulations on the aforesaid pre-exists.
