Are individuals and enterprises permitted to import Covid-19 vaccines for private use?

 Currently, the State has licensed Covid-19 vaccines for use within the territory of Vietnam. Because of wishing to urgently vaccinate their employees, many enterprises have imported Covid-19 vaccines at their discretion for their own use. However, is this allowed?

 The Resolution No. 21/NQ-CP, issued on February 26, 2021, regulates the purchase and use of COVID-19 vaccines.

 As per regulations laid down in clause 7 of Article 4 in this Resolution, the State encourages competent entities to organize voluntary vaccination if they have demands and can pay for vaccination at their own expense.



 Organizations, units and enterprises are allowed to use funds within the recurrent expenditure estimates covered by the law on state budget or operating funding sources as prescribed by laws or operating expenditures prescribed by laws or recorded as deductible expenses for determination of taxable income according to the corporate income tax law, in order to vaccinate their employees.

 Therefore, many enterprises believe that “importing” vaccines for their employees’ use and at their own expense is not contrary to the State's guidelines.

 However, point a of clause 1 of Article 4 in this Resolution has the following regulation:

     “Article 4. Implementation

     1. The Ministry of Health:

     a) Act as a central point to purchase, import, receive donated or secured vaccines; be held accountable for quality, prices; manage, distribute, ensure public disclosure and transparency, prevent waste and misconduct as directed by the Politburo, Secretariat in the Official Dispatch No. 50-CV/VPTW dated February 19, 2021 and the Standing board of Government in the Official Dispatch No. 312/VPCP-KGVX dated February 8, 2021.”

 According to this regulation, the Ministry of Health is the only presiding entity that purchases and imports vaccines. Enterprises can be proactive in organizing vaccination and encouraged for self-payment, but the import of vaccines is under the authority of the Ministry of Health.

 Thus, individuals and the State do not have any regulatory policy for individuals and enterprises to import Covid-19 vaccines by themselves. This is also an approach to managing and controlling risks because of the fact that vaccines imported in such a way can harm people's health.
