1. Ho Chi Minh City
Legal base: Decision No. 33/2014/QD-UBND
This Decision applies to newly-formed land lot and land parcels of which the splitting is not prohibited:
For the purpose of meeting readers’ search demands relating to land lot splitting, I would like to present to you an overview of regulations in force on permissible minimum areas of individual land lots split from residential parcels in 63 nationwide cities and provinces.
1. Ho Chi Minh City
Legal base: Decision No. 33/2014/QD-UBND
This Decision applies to newly-formed land lot and land parcels of which the splitting is not prohibited:

2. Ha Noi City
Legal base: Decision No. 20/2017/QD-UBND
- The land lot has both width of the frontage and depth from a setback line (the boundary line from which construction of the property on the land lot is allowed) which are measured as at least 3 meters;
- The land lot must cover a minimum area of 30 m2 if it is located at wards or towns, and must not be less than 50% of the latest stipulated limit on allocated land (the minimum level) if it is located within other communes.
3. Bac Ninh
Legal base: Decision No. 529/2014/QD-UBND
- The minimum area of an urban land lot, a land lot along a national highway, provincial road, and a land lot within a future urban area, which is formed after the splitting process corresponds to the approved detailed planning; in the absence of that planning, a split land lot must have the minimum area of 40 m2 or higher and dimension of each side which is not less than 3.5 m.
- The minimum area of a rural land lot other than those of a aforesaid type after being split is appropriate to the approved detailed planning; in the absence of that planning, a split land lot must have the minimum area of 70 m2 or higher and dimension of each side which is not less than 4 m.
4. Quang Tri
Legal base: Decision No. 05/2015/QD-UBND
- The minimum area of newly-formed land lot
The newly-formed or residual lot of land after being split (after deduction of the area of public utilities easement) must correspond to the land use planning and must have the following minimum dimensions:
- Residential land:
+ The urban land lot has the minimum area of 40 m2, the minimum width of frontage which is 4.0 m and the minimum depth from the setback line which is 9.0 m;
+ The rural land lot has the minimum area of 60 m2, the minimum width of frontage which is 5.0 m and the minimum depth from the setback line which is 9.0 m.
5. Long An
Legal base: Decision No. 65/2016/QD-UBND
a. Urban land (at wards or towns)
* With respect to the land parcel used for building a house which is adjacent to a road with the width between its two boundary lines which is greater than or equal to 20 m, after the land split and deduction of the setback area, both the newly-formed land lot and the remaining land lot must conform to requirements concerning the minimum size and dimensions as follows:
The minimum area of the land lot used for building a house is 45 m2, including:
- The minimum width of that land lot used for building a house is 5 m;
- The minimum depth of that land lot used for building a house is 5 m;
* With respect to the land parcel used for building a house which is adjacent to a road with the width between its two boundary lines which is less than 20 m, after the land split and deduction of the setback area, both the newly-formed land lot and the remaining land lot must conform to requirements concerning the minimum size and dimensions as follows:
The minimum area of the land lot used for building a house is 36 m2, including:
- The minimum width of that land lot used for building a house is 4 m;
- The minimum depth of that land lot used for building a house is 4 m.
* With respect to the land lot used for building a house which is not adjacent to any road or is adjacent to a road of which the width between its two boundary lines is not specified, after the land split, the area of the newly-formed land lot and the remaining land lot must conform to requirements concerning the minimum area and dimensions as follows:
The minimum area of the land lot used for building a house is 80 m2, including:
- The minimum width of that land lot used for building a house is 4 m;
- The minimum depth of that land lot used for building a house is 15 m.
b. Rural land (at communes)
* With respect to the land parcel used for building a house which is adjacent to a road with the width between its two boundary lines which is greater than or equal to 20 m, after the land split and deduction of the setback area, both the newly-formed land lot and the remaining land lot must conform to requirements concerning the minimum size and dimensions as follows:
The minimum area of the land lot used for building a house is 100 m2, including:
- The minimum width of that land lot used for building a house is 5 m;
- The minimum depth of that land lot used for building a house is 15 m.
* With respect to the land parcel used for building a house which is adjacent to a road with the width between its two boundary lines which is less than 20 m, after the land split and deduction of the setback area, both the newly-formed land lot and the remaining land lot must conform to requirements concerning the minimum size and dimensions as follows:
The minimum area of the land lot used for building a house is 80 m2, including:
- The minimum width of that land lot used for building a house is 4 m;
- The minimum depth of that land lot used for building a house is 15 m.
* With respect to the land lot used for building a house which is not adjacent to any road or is adjacent to the road of which the width between its two boundary lines is not specified, after the land split, the area of the newly-formed land lot and the remaining land lot must conform to requirements concerning the minimum area and dimensions as follows:
The minimum area of the land lot used for building a house is 100 m2, including:
- The minimum width of that land lot used for building a house is 4 m;
- The minimum depth of that land lot used for building a house is 20 m.
6. An Giang
Legal base: Decision No. 103/2016/QD-UBND
- With respect to land used for residential, commercial and manufacturing purposes:
+ Stipulated minimum area:
At wards: 35 m2;
At towns: 40 m2;
At communes: 45 m2.
+ In addition to compliance with the stipulated minimum areas shown above, a split land lot must have at least one side abutting onto the existing road of which the length is prescribed as follows:
If it abuts onto the road of class 1, 2, 3 or 4 (according to road classification) or a national highway or a provincial road, the length equals 4 meters;
If it abuts onto a road other than the aforesaid, the length equals 2 meters.

8. Ba Ria - Vung Tau
Legal base: Decision No. 23/2017/QD-UBND
- The minimum area and dimensions of the remaining land lot after the land split (exclusive of the area of road reserve or road which is specified according to the planning) must conform to the following regulations:
+ With respect to residential land on which a building already exists:
If that land lot is located at wards, it must cover a minimum area of 45 m2 and have a side adjacent to a road which is not less than 5m and its depth which is not less than 5m from the street of which the width between its two boundary lines is > 20 m; cover a minimum area of 36 m2 and have a side adjacent to a road which is not less than 4m in width and its depth which is not less than 4m from the street of which the width between its two boundary lines is less than 20m; If that land lot is located at towns, communes and Con Dao district, it must cover a minimum area of 40 m, and have the depth and the width of the side adjacent to a road which is not less than 4m.
+ With respect to vacant residential land:
If that land lot is located at communes, wards and towns of an urban zone and the center of Con Dao district, it must cover a minimum area of 60 m2 and have a side adjacent to a road which is not less than 5m and its depth which is not less than 5m. If that land lot is located at other communes and other subdivisions of Con Dao district, it must cover a minimum area of 100 m2 and have a side adjacent to a road which is not less than 5m in width and its length which is not less than 5m.

10. Bắc Giang
Legal base: Decision No. 745/2014/QD-UBND
- The minimum area of an urban residential land, a residential land located along a national highway, provincial road and within a planned urban development area after being split will be subject to the approved detailed planning; in the absence of the approved detailed planning, the split land lot must cover a minimum area of 24 m2, a side of frontage which is at least 3m wide, has the minimum depth of 5.5m; if an entrance to a rear land lot is required, the minimum width of that entrance is 1.5 m.
- The minimum area of a rural residential land and any land other than the aforesaid after being split will be subject to the approved detailed planning; in the absence of the approved detailed planning, the split land lot must cover a minimum area of 48 m2, a side of frontage which is at least 04m wide, has the minimum depth of 08m; if an entrance to a rear land lot is required, the minimum width of that entrance is 1.5 m.
- If a tenant wishes to split a land lot to match a contiguous one, the remaining land lot after split and the newly-formed land lot after combination must have their minimum area, frontage width, depth, width of the entrance to a back land lot which are subject to the abovementioned regulations.
11. KonTum
Legal base: Decision No. 62/2014/QD-UBND
a. The area and dimensions of an individual land lot formed after split must be the same as those specified in the approved detailed planning.
b. If a land lot is located within an area which has not had the detailed construction planning or land use planning, or has such kind of planning that has not specified the area and dimensions of a land lot, the allowed minimum area of a split land lot will be subject to the following regulations:
* Urban residential land:
If the land lot is not adjacent to a road, it must satisfy the following requirements:
+ The allowed minimum area after split is 40m2;
+ The minimum width after split is 4.0m; the minimum length after split is 4.0m;
If the land lot is adjacent to a road of which the width between its two boundary lines is at least 20m, it must satisfy the following requirements:
+ The allowed minimum area after split is 45m2;
+ The minimum width after split of the side abutting onto a road is 5.0m; the minimum length after split is 6.5m.
If the land lot is adjacent to a road of which the width between its two boundary lines is less than 20m, it must satisfy the following requirements:
+ The allowed minimum area after split is 40m2;
+ The minimum width after split of the side abutting onto a road is 4.0m; the minimum length after split is 5.5m.
* If the split land lot is located in rural areas, it must satisfy the following requirements:
- The allowed minimum area after split is 72m2;
- + The minimum width after split is 4.5m; the minimum length after split is 16m.
12. Bac Kan:
A residential land parcel is allowed for split if each of individual land lots newly formed from it covers a minimum area of 30 m2 (exclusive of the area of public utilities easement) and has a side adjacent to a road or entrance of which the minimum length is 03m, and is given a certificate or qualifies for a certificate, conforms to the land use planning approved by competent authorities and is not in dispute.

13. Lai Chau
The minimum area of a residential land parcel allowed for split must correspond with regulations on construction of residential property:
- The land lot split from an urban residential land must cover a minimum area of 80 m2 and is at least 4m wide;
- The land lot split from a rural residential land must cover a minimum area of 120 m2 and is at least 5m wide;
- If a land plot requiring split has its area which is less than the prescribed minimum area, but meets requirements concerning the prescribed minimum area and dimensions when being combined with another land lot, the land split is allowed.

14. Bac Lieu
* Urban residential land:
- House lot: The minimum area is not less than 35m2, its width is at least 3.5m and the depth from the setback line is at least 04m.
- Vacant lot: The minimum area is not less than 40m2, its width is at least 04m and the depth from the setback line is at least 04m.
* Rural residential land:
- House lot: The minimum area is not less than 50m2, its width is at least 04m and the depth from the setback line is at least 04m.
- Vacant lot: The minimum area is not less than 60m2, its width is at least 04m and the depth from the setback line is at least 04m.
* In case of application for split of a land lot into multiple lots of which the area is less than the allowed minimum area and combination of these lots with other adjacent ones to make a new lot of which the area is equal to or greater than the minimum area prescribed herein, such split and combination of land will be approved and land lots created therefrom will be given certificates.

18. Lao Cai
* At areas which have had the approved and released detailed plan of 1/500 scale, or zones developed in conformity with the urban regulations.
A land lot newly formed after split from a land parcel in use must have the permissible minimum area and dimensions in conformity with the approved planning or the approved urban regulations.
* At areas which have not had the approved and released detailed plan of 1/500 scale, or zones developed in conformity with the approved urban regulations.
* Urban areas:
A land lot in use to be split into a new land lot must cover an area of 60.0 m2 and satisfy the following requirements:
- The land lot with a side abutting onto a road
+ The width of the side abutting onto a road must not be less than 3.5 m;
+ The depth of the land lot must not be less than 10.0 m.
- The land lot without any side abutting onto a road
+ The width of the land lot must not be less than 3.5 m;
+ The length of the land lot must not be less than 10.0 m.
At rural areas including centers of communes (appropriate to the approved planning boundaries), or on national highways, provincial roads, inter-district or –commune roads and areas where technical infrastructure has been developed.
A land lot in use to be split into a new land lot must cover an area of 100.0 m2 and satisfy the following requirements:
- The land lot with a side abutting onto a road.
+ The width of the side abutting onto a road must not be less than 5.0 m;
+ The depth of the land lot must not be less than 12.5 m.
- The land lot without any side abutting onto a road.
+ The width of the land lot must not be less than 5.0 m;
+ The length of the land lot must not be less than 12.5 m.
At areas other than the aforesaid:
A land lot in use to be split into a new land lot must cover an area of 150 m2 and satisfy the following requirements:
- The land lot with a side abutting onto a road.
+ The width of the side abutting onto a road must not be less than 8.0 m;
+ The depth of the land lot must not be less than 15.0 m.
- The land lot without any side abutting onto a road.
+ The width of the land lot must not be less than 8.0 m;
+ The length of the land lot must not be less than 15.0 m.
