After the trial yesterday (3/02/2017), Doan Thi Huong has
been charged with "murder" under the Malaysian Criminal Code and would risk facing the
death penalty in this country.
How is the
death penalty in Malaysia specified? Is there anything different from Vietnam's
Law?
In Malaysia, the death sentence is only for very serious crimes such as rape, murder,
treason ... and particularly the foreigners accused of this sentence in this country is not
exempt. And only appellate court has the power to declare the punishment.
When
conviction of death sentence in Malaysia, whether it likes or not, the
appeal process is mandatory for any circumstances. And when he is sentenced in
the appeal court judgment, the only way to escape the death penalty is to get clemency of law.
There is a special
thing, the death penalty in Malaysia is executed in the form ... hanged.
Perhaps this is the most remarkable thing about the death penalty in this
country. According to the trend of the world's countries, the death penalty is increasingly
towards less painful for execution, some countries have even dropped the this sentence for the crime.
Forms of execution in Malaysia...
sounds rather frightening and certainly people shall suffer great pain before death.
Form of
hang and some other provisions in the regulations on the death penalty
in Malaysia are considered as
"inappropriate" with international trends by Amnesty International. In this
country, only children and pregnant women has not been put sentenced to death. In other cases, just based on
the behavior if properly prescribed to receive the death penalty, there is no
other way to escape a sentence, there is no provision to consider the
conditions, circumstances and crime
motive.
