PROCEDURE FOR LAND ALLOCATION OF INDIVIDUALS

Individuals here are understood under the provisions of Paragraph 2, Article 5 of the Land Law 2013.

Before performing the procedures to apply land allocation dossier, you have to be considered as a case of Land allocation with land use levy. Accordingly, Decree 45/2014/ND-CP stipulates:

1. Entities allocated land by the State for use in the following cases:
a/ Households and individuals that are allocated residential land;
….

If individuals are in any of the above cases, they may carry out procedures of land allocation with land use levy:

Step 1: Apply dossiers at District-level Natural Resources and Environment Divisions:

Dossier is defined in Article 4 of Circular 30/2014/TT-BTNMT include the following documents:

– Application for land allocation or lease Form 01 promulgated with Circular 30/2014/TT-BTNMT.

– Copy of the land lot's cadastral map (District-level Natural Resources and Environment Divisions are responsible for providing Copy of the land lot's cadastral map for places where the cadastral map or perform a parcel of land cadastral measurements at the request of the applicant for land allocation, lease)

– Certificate of the land use demand.

Step 2: District-level Natural Resources and Environment Division shall evaluate land allocation, land use demand;

- If the record is correct, complete and valid, write a receipt.

- In case of missing and invalidation, the officer guides the applicants remake.

Step 3: To submit to District-level People's Committees (DPC) that decides to allocate land:

After receiving a valid dossier, District-level Natural Resources and Environment Division will submit the dossier to the DPC, including:

- Documents as Step 1.

- The report accompanying the draft decision on land allocation (Form 02) issued with Circular 30/2014 / TT-BTNMT.

Land allocation or lease: 20 days excluding the time for ground clearance.
