SECURITIES COMPANY – MAINTAINING STRICT CONTROL OVER OPERATION
New amendments of guidelines on establishment and operation of Securities Company shall become effective from March 15th, 2016.
Accordingly, the Circular no. 07/2016/TT-BTC amended to the Circular no. 210/2012/TT-BTC. Details are:
- Securities company is entitled to conduct margin trading and lend money to customers to purchase securities under form of margin trading.
- This kind of company is entitled to lend securities for correcting trading errors, or conducting tradingin exchange-traded fund certificate or serving other trading forms as regulated by relevant laws.
- Securities company is not entitled to use money and assets of the company or its customers for ensuring settlement obligations of the third party.
- Securities company is not entitled to directly conduct or entrust other organization or individual to conduct the following activities:
- Investing more than 15% of total circulating stocks or fund certificates of unlisted organization. This regulation shall not apply to member fund certificates, exchange-traded fund certificate and open-end fund certificates.
- Investing or contributing more than 15% of equity to an organization or business project.
