Significant regulations of Law on Children (Amended)
In April 5th 2016, Law on Children (Amended) was passed by
Vietnamese National Assembly with a new significant point - Confidential rights.
After presenting explanatory report about the acquisition
and revision of the draft, most of delegates agreed to rename from Law on Protection,
Care and Education of Children to Law on Children.
On the rights and duties of children are prescribed in the
Law, Ms. Nguyen Thanh Hai (a member of the National Assembly Standing Committee)
said that some delegates suggested that Congress should review the provision on
the confidential right of private life ( Article 21 of the draft Law).
If this provision were passed, the behavioral surveillance
of parents would become an illegal act. While most children might not be mature
enough to aware both of good and bad behaviors, their parents must have the right
of control their children in some activities.
Beside that, the regulation of rights relating to making friends
freedom also should be revised because the parents would
be passive with the solution preventing their children from bad social relationships.
After receiving the ideas from delegates, although Standing
Committee still retained the provisions on the confidential right to private
life, they provided the additional requirement associated with the best
interests of the child and responsibilities of parents, teachers, caregivers,
and family members.
The phrase of “making friends freedom” was also omitted;
however, children still have rights to meeting friends.
About identifying the age of children, 86% delegates agreed that people under sixteen years old would be children.

Law on Children (Amended) will takes effect from
June 1st 2017.
