NEW PROVISIONS ABOUT VIETNAM E-COMMERCE SERVICE APPLICATIONS

For management of e-commerce service via mobile applications, new provisions has entered into force in this March.

Pursuant to Circular No. 59/2015/TT-BCT, the application for registration of e-commerce service applications includes:
  • Application form for registration of e-commerce service applications;
  • Authenticated copy of the establishment decision (in respect of organizations), business registration certificate, investment certificate or investment license (in respect of traders);
  • Scheme for providing e-commerce services, including contents referred to in paragraph 3 Article 54 of the Decree No.52/2013/ND-CP;
  • Rules for management of operations of e-commerce service applications;
  • Form of the service contract or cooperation agreement between traders or organizations in possession of e-commerce service applications with traders, organizations or individuals involved in buying, selling or holding auction or promotion of goods or services via such applications;
  • General terms and conditions applied to transactions such as sale, purchase, auctioning or promotion of goods or services on these applications (if applicable).
From March 31, 2016, this Circular will enter into force.
