VIETNAMESE PRECEDENT SYSTEM – UPDATING 10 NEW DECISIONS

Supreme People’s Court updated 10 new civil cassation decisions in the first Vietnamese precedent collection which is going to be published in this April.
Details are:
  1. Cassation decisions no. 27/2010/DS-GĐT dated in 8th July 2010 of the Council of Judges of the Supreme People’s Court on the civil case about “Disputing over reclaiming the property”.
  2. Cassation decisions no. 28/2011/DS-GĐT dated in 18th August 2011 of the Council of Judges of the Supreme People’s Court on the civil case about “Disputing over house and land ownership”.
  3. Cassation decisions no. 12/2012/DS-GĐT dated in 13th January 2012 of the Council of Judges of the Supreme People’s Court on the civil case about “Reclaiming the property”.
  4. Cassation decisions no. 44/2013/DS-GĐT dated in 22nd May 2013 of the Council of Judges of the Supreme People’s Court on the civil case about “Disputing over property inheritance”.
  5. Cassation decisions no. 88/2013/DS-GĐT dated in 11th July 2013 of the Council of Judges of the Supreme People’s Court on the civil case about “Disputing over property inheritance”.
  6. Cassation decisions no. 94/2013/DS-GĐT dated in 25th July 2013 of the Council of Judges of the Supreme People’s Court on the civil case about “Disputing over property ownership”.
  7. Cassation decisions no. 34/2014/DS-GĐT dated in 11th July 2014 of the Council of Judges of the Supreme People’s Court on the civil case about “Disputing over reclaiming property”.
  8. Cassation decisions no. 39/2014/DS-GĐT dated in 09th October 2014 of the Council of Judges of the Supreme People’s Court on the civil case about “Disputing over property inheritance”.
  9. Cassation decisions no. 48/2014/DS-GĐT dated in 20th November 2014 of the Council of Judges of the Supreme People’s Court on the civil case about “Disputing over Sale contracts of houses”.
  10. Cassation decisions no. 215/2014/DS-GĐT dated in 5th June 2014 of the Council of Judges of the Supreme People’s Court on the civil case about “Disputing over property inheritance”.
Furthermore, they also retrenched some inconsonant or repeated cases, as follows:

  1. Cassation decisions no. 18/2011/DS-GĐT dated in 29th June 2011 of the Council of Judges of the Supreme People’s Court on the civil case about “Disputing over land use right”.
  2. Cassation decisions no. 82/2013/DS-GĐT dated in 8th July 2013 of the Council of Judges of the Supreme People’s Court on the civil case about “Disputing over house purchase contract”.
  3. Cassation decisions no. 94/2013/DS-GĐT dated in 25th July 2013 of the Council of Judges of the Supreme People’s Court on the civil case about “Disputing over property ownership”
